ny US importer who paid IEEPA tariffs between February 4, 2025 and February 24, 2026 is potentially eligible. This covers duties paid on entries with HTS codes beginning with 9903.01.xx (fentanyl tariffs) and 9903.02.xx (reciprocal tariffs). Section 232 tariffs on steel, aluminum, and autos are not included.
CBP has confirmed that importers will not be able to receive funds unless they have registered with ACE and completed the process of setting up their account to receive refunds electronically. Until importers complete this, refunds "will be rejected." Phillipslytle Less than 10% of eligible importers have done this so far.
CAPE, Consolidated Administration and Processing of Entries, is CBP's new automated refund system being built inside ACE. Importers will file declarations in ACE listing all entries on which IEEPA duties were paid. CBP will then validate the data, automatically liquidate or reliquidate entries, and issue electronic refunds.
CBP has committed to issuing refunds for all 53 million entries that included IEEPA duties including finally liquidated entries, though those will be addressed in a later phase of CAPE. For now, filing a protest within 180 days of liquidation is still recommended to protect your rights.
The current timeline is unkown, experts are guessing anywhere from 1 month to 3 years for the entire process.
